Permission for Construction of Swimming Pools
The building permit for the construction of a swimming pool is mandatory and required by law.

The Legal Framework for Urban Planning and Building - Decree-Law No. 555/99 of 16/12, with the applicable amendments - states the following in Article 4:
Article 4 - Approval, Prior Notice, and Authorization for Use
 
1 - The execution of urban planning measures depends on an approval, prior notice with a deadline, hereinafter referred to as prior notice or notice, or an authorization for use, in accordance with the provisions and exceptions of this section.

2 - The following measures are subject to administrative approval:

a) The division of plots into building plots;
b) Works for development and works for the restructuring of plots in an area not covered by a plot division;
c) Construction, alteration, or extension works in an area not covered by a plot division or a detailed plan;
d) Construction, restoration, extension, alteration, or demolition works of classified buildings or buildings to be classified, as well as of buildings integrated into classified ensembles or sites, and construction, restoration, extension, alteration works or demolition works of buildings located in protection zones of classified buildings or buildings to be classified;
e) Reconstruction works that result in an increase in the height of the facade or the number of floors;
f) Demolition works of buildings not provided for in an approval for restoration works;
g) [Revoked];
h) Construction, restoration, extension, alteration, or demolition works of buildings in areas subject to administrative servitude or restriction of public utility, without prejudice to specific legislation;
i) Urban planning measures that result in the removal of facade tiles, regardless of their confrontation with the public street or courtyard;
j) Other urban planning measures not subject to prior notice or exempted from prior control, in accordance with this decree.

3 - The obligation to obtain approval for the division of property resulting in plots not immediately intended for urbanization or construction depends on the will of the owners.

4 - The following urban planning measures are subject to prior notice:

a) Reconstruction works that do not result in an increase in the height of the facade or the number of floors;
b) Works for development and works for the restructuring of plots in an area covered by a plot division;
c) Construction, alteration, or extension works in an area covered by a plot division or a detailed plan;
d) Construction, alteration, or extension works in a consolidated urban area that comply with municipal or intermunicipal plans and do not result in a building with a height greater than the most frequent height of the facades of the built front on the street side where the new building is integrated, in the street section between the two nearest cross streets, on both sides;
e) The construction of swimming pools in connection with main buildings;
f) Urban planning measures preceded by favorable preliminary information, in accordance with paragraphs 2 and 3 of Article 14.
g) [Revoked].
h) [Revoked].

5 - The use of buildings or their parts, as well as changes in their use, are subject to approval.

6 - In urban planning measures subject to prior notice, the interested party may, in the initial application, opt for the approval procedure."

According to point e) of Article 4, the construction of a swimming pool (next to an existing building/house), regardless of the construction method used, is subject to a project - prior notice (or approval if preferred - point 6 of Article 6).

In other words, it doesn't matter if your swimming pool is prefabricated in fiberglass, steel sheet, or made of biological materials - all construction methods are covered by the decree of law.

Therefore, swimming pool construction companies are always obligated to inform their customers about the validity of the decree of law, debunking the myth that certain types of construction, such as fiberglass or steel sheet pools, do not require approval, just to sell their product.
